Tax-deferred property exchange

1031 exchanges: defer taxes and reinvest

Sell an investment property and roll the gain into the next one, on schedule.

Overview

1031 Exchange, handled as part of the deal

A Section 1031 exchange lets you defer capital gains tax when you sell investment or business real estate and reinvest in like-kind property. The rules are strict and the deadlines do not move, so the exchange has to be planned before the sale closes.

Andy coordinates the real estate side of the exchange: finding and securing replacement property, working with your qualified intermediary, and tracking every deadline.

It is one piece of a bench of independent specialists who already work with Andy, so you deal with one person from first call to closing.

1031 Exchange questions

What are the 1031 exchange deadlines?

You have 45 days from the sale of your property to identify replacement property in writing, and 180 days from the sale to close on it. The two periods run at the same time and are not extended for weekends or holidays.

Do I need a qualified intermediary?

Yes. The sale proceeds must go to a qualified intermediary, not to you. If you receive the money, the exchange generally fails.

Can I exchange into a different type of property?

Generally yes. Like-kind covers most real property held for investment or business use, so an office building can be exchanged for industrial or retail property. Your tax advisor should confirm your situation.
